1. Overview

This website, entermotus.com (the "Site"), is operated by URT Inc. doing business as MOTUS ("MOTUS," "we," "us," or "our"). By visiting the Site or purchasing from us, you agree to these Terms of Service ("Terms"), along with our Privacy Policy, Refund Policy, and Shipping Policy, which are incorporated by reference. If you do not agree, please do not use the Site.

The Site is hosted on Shopify Inc., which provides the e-commerce platform that lets us sell to you.

2. Eligibility

By using the Site, you confirm that you are at least the age of majority where you live, or that you are using the Site with the consent and supervision of a parent or legal guardian.

3. Products and availability

We make every effort to display product colors, images, and details accurately, but we can't guarantee that your screen will show colors exactly. Many MOTUS products are released in limited quantities. All products are subject to availability, and we may limit quantities, discontinue products, or refuse any order at our discretion, including orders that appear to be placed by resellers, dealers, or automated tools.

4. Pricing and payment

Prices are shown in US dollars unless your local currency is displayed at checkout. Prices may change without notice. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you in full, even after you've received an order confirmation. You agree to provide current, complete, and accurate purchase and account information, and you authorize us and our payment processors to charge your selected payment method for your order, including applicable taxes and shipping.

5. Orders, shipping, and returns

Your order is an offer to buy, which we accept when we ship it. Title and risk of loss pass to you when the carrier takes possession of your order. Shipping and returns are governed by our Shipping Policy and Refund Policy.

6. Intellectual property

All content on the Site, including the MOTUS name, logos, graphics, designs, photography, and text, is owned by or licensed to MOTUS and is protected by copyright, trademark, and other laws. You may not copy, reproduce, sell, or exploit any part of the Site or our designs without our written permission.

To the fullest extent permitted by law, MOTUS, URT Inc., and their owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any product. Our total liability for any claim related to a product will not exceed the amount you paid for that product.

12. Indemnification

You agree to indemnify and hold harmless MOTUS and URT Inc. from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or third-party rights.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.

14. Severability and entire agreement

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver.

We may update these Terms at any time by posting the revised version on this page. Changes apply to orders placed after they're posted. Continued use of the Site means you accept the updated Terms.
